Terms of Sale (European Update)

1. Seller Identity

The seller through the online store PegasoAvionics is the company Pegaso Team S.a.s., with VAT number 11395900159 and registration in the Milan Business Register under number 1461452, with its registered and operational office located at Via Parlamento 6b, 20098 San Giuliano Milanese (MI), Italy.

2. General Provisions

The general terms and conditions of sale (hereinafter "GENERAL CONDITIONS") are provided by Pegaso Team S.a.s. to ensure transparency and completeness and apply to all sales of products purchased through the website. Pegaso Team S.a.s. reserves the right to modify these conditions, urging customers to review them before making any purchase. The confirmation of an order implies the tacit acceptance of the updated general conditions.

Consumer Rights: According to European e-commerce and consumer protection regulations (Directive 2011/83/EU), the commercial relationship between the seller and the consumer is governed by the Italian Consumer Code (D.Lgs. 206/2005) and European legislation on distance contracts.

Exclusions: Professionals (i.e., customers purchasing with VAT numbers) are not covered by consumer protection regulations, including the right of withdrawal and other protections under D.Lgs. n. 185/1999 (distance contracts), D.Lgs. n. 50/1992 (right of withdrawal), and the Civil Code.

3. Prices and Payments

The price of the products includes all applicable taxes, including VAT, and is expressed in Euros. Shipping costs are separate and depend on the weight of the order and the destination (Italy or Europe). Any additional services (such as express delivery or insurance) are specified at checkout.

Payment Methods:
Customers can choose from the following payment methods:

• PayPal (including the "Pay in 3 installments" option via PayPal)
• Credit card
• Satispay
• Klarna - Pay in installments (possibility to split the payment into monthly installments)

Invoicing: Customers who need an invoice must register as a business during their first registration, where the data for the issuance of the invoice or reverse charge exemption will be verified.

4. How to Place Orders

Orders can be placed by filling out an electronic order form. The customer must add the product to the cart, read and accept the General Conditions and the Privacy Policy, enter shipping and billing details, choose the payment method, and confirm the order. The contract is concluded when the order is accepted and confirmed via email by the seller.

5. Delivery

Pegaso Team S.a.s. commits to shipping orders to the address provided by the customer using express couriers. Shipments take place from Monday to Friday, excluding holidays, with delivery times ranging from 2 to 15 working days, depending on the destination. The customer will receive a confirmation email with a tracking number to follow the status of the shipment.

6. Right of Withdrawal

In accordance with Directive 2011/83/EU on consumer protection and the Italian Consumer Code (D.Lgs. 206/2005), consumers have the right to withdraw from the purchase contract within 14 working days from the receipt of the product, without providing any reasons. Certain products, such as personalized or perishable goods, are excluded from the right of withdrawal, as specified in Article 59 of D.Lgs. 21/2014.

Withdrawal Procedure:

• The customer must send a withdrawal notice within 14 working days from receiving the product by sending a registered letter with acknowledgment of receipt to the Pegaso Team S.a.s. address.
• Return shipping costs are at the customer's expense, and the risk of damage or loss during shipping is the responsibility of the customer until the product is received at our warehouse.
• The refund will be made within 30 days of the product's return, via credit card, PayPal, or bank transfer, depending on the payment method used.

8. Protection of Minors

Minors under 18 years of age are not authorized to make purchases through the website unless under the supervision of an adult family member.

9. Disputes

For any disputes related to these general sales conditions, the competent court is the one in Milan, in accordance with European regulations governing dispute resolution in distance contracts.
